    Default Maintenance Can't Fix Leaking Air Conditioner

    My question involves landlord-tenant law in the State of: Florida

    Our AC unit has been leaking non-stop for the last 2 months. Maintenance has been over 3x to "fix" this, but all they've done is change the filter, then hook up a vacuum to the outside of our unit and pump out the water. This worked the first time, but the 2nd and 3rd time, it did nothing. The ceiling has clear and visible water damage, as well as the carpet underneath the vent.

    This morning, I called the office and told them, "Maintenance has been here several times but have not fixed the problem, the ceiling is starting to sag from water damage and there is visible mold growing around the area." 3 hours later someone showed up, did not come into my apartment, but hooked up the pump outside and then left. The pump has been running for 2 hours now and the AC is still leaking.

    My girlfriend has been getting sick at least once a month for the last 6 months and we're starting to think it's the mold causing her to get sick. Also, this apartment complex has TERRIBLE ratings on Yelp concerning the mold issue in other apartments.

    We just re-signed our lease last month and one thing they told us was to alert them about any mold as it's quite common here in Florida. We have done that and have obviously told them several times that the AC is still not fixed. The damage is getting worse, literally, by the hour.

    What are our options as far as taking care of this problem?

    have you asked if you are allowed to continue to use the AC although it is leaking?

    If they say no, then refer to your lease. If it includes AC, then the LL must do something to provide you with AC lest it be a breach of the contract which gives you some actions.

    If they say yes, make sure you send them a letter informing them of the issue. I would send it certified mail.

    This is a window air conditioner, then? Although being able to see the unit would help, two possibilities immediately occur to me: the drain is plugged, or the unit has shifted and the inside edge of the unit is lower than the outside edge such that water pools and eventually leaks out.

    I'm thinking it is an attic installed AC with the drain running across the ceiling to the exterior wall. Once the drain tube is plugged, the condensation would overfill the catch pan and subsequently run out onto the ceiling below.


    the problem is often nothing more than the drain tube becoming plugged but in installations where there would be a pump used, the pump could also be malfunctioning.

    It could also be a deteriorated catch pan as well.
