    Default Assault Statute of Limitations in Virginia

    I assaulted someone in 2000. No charges were files, but a police report was taken.

    Can the person that I assaulted still file charges?

    Assuming it would have been charged as a misdemeanor, according to the Virginia Code, § 19.2-8, "A prosecution for a misdemeanor, or any pecuniary fine, forfeiture, penalty or amercement, shall be commenced within one year next after there was cause therefor, except that a prosecution for petit larceny may be commenced within five years, and for an attempt to produce abortion, within two years after commission of the offense."

    Thanks for the response. So from my understanding I'm in the clear.

    The only reason I ask is because this person is related to my fiance, and now they are trying to blackmail me with it.
