    Default Can I Be Arrested for Theft Without Evidence

    My question involves criminal law for the state of: California

    Recently, I have been receiving calls from a detective. I was involved in a crime in which something expensive was stolen from my high school, and the school pressed charges. Two people have blamed me when questioned by the detective, and stated that I took the stolen item.

    Every time the detective calls, I refuse to be questioned without an attorney present. Today the detective called and told me to go to the police station and turn myself in, and that we need to talk in person, and he said he has probable cause to arrest me. He threatened to come to my house and arrest me. I'm currently not even in the state where all of this is happening, I am elsewhere visiting family.

    Can I be arrested without evidence? Other than two people blaming me for the crime, there is no evidence of my actually committing any crime at all. The stolen item wasn't even found with me, it was found in my friend's car. Help please?

    Actually, two witnesses is somewhat compelling evidence. Talk to your lawyer.

    Do not speak to police without a lawyer present. Even if they arrest you.

    I would seriously consider a consultation with a lawyer when you are done visiting family. Many will offer a free consult.

    The two people blaming you, that's "evidence."

    And that's all the police need to arrest you.

    Hire a lawyer as soon as you get home and let him do the talking for you.

    And if a warrant is issued, it will exist forever. Hiding from the issue will not make it go away. If they have probable cause to arrest you, they can seek an arrest warrant for you and that would dog you for the rest of your life - even if you stay out of state.
