    Default Can I Get My Share of the Security Deposit Back if My Roommate Renews the Lease

    My question involves landlord-tenant law in the State of: Maryland

    Hello,

    I signed a 1 year lease with my roommate at an apartment complex in Baltimore County. We need to give 90 days written notice if we will be renewing the lease or moving out. My roommate wants to renew, I do not. I will be writing a certified letter stating that I will not be renewing the lease. My roommate will need to reapply for a lease on her own because of this which she plans on doing. Does anyone know what will happen to the security deposit? Will I get my share back or is it just going to roll over onto her new lease?

    It should be returned as the "tenant" of the old lease is not the "tenant" of the new lease. The old lease is ending so it should be fully closed out. Make sure you retain a copy of the notice, including the pertinent dates of sending and such, for a long time. You wouldn't be the first person a landlord went after when the other tenant finally moved and owed more than their deposit would cover. It is not your obligation but that doesn't mean they won't try to get it from you.

    They usually put both names of the lessee's on the check. It will be up to you both to cash it and splt it up. I have yet to see a management company split up a deposit.

    Are you on good terms with your roommate? I agree with the above poster. Retain the certified I mail receipts and letter for a long time. Also, I would try and talk with the property mgr. they may need both signatures on the "will not renew" a paper.

    Thank you for your input. My roommate asked me this morning if I would be willing to sign something from the management office agreeing that I will put my portion of the security deposit towards her new lease and she would pay me back once her new roommate moved in. We are on good terms, however, I am not sure I feel comfortable with this. I haven't seen the paperwork yet. I should be able to get my security deposit back if I refuse to sign, right?
