    Default Weekly Beach Rental Problem

    My question involves landlord-tenant law in the State of: Virginia

    Our family of 20 has rented a beach house for 1 week beginning tomorrow and our rental agent disclosed to us YESTERDAY that there is beach restoration ongoing that may affect our beach access for a day or two. Upon visiting the property today, it was clear that direct beach access will likely not be available the entire week, and, the project has been ongoing for quite a while. Our view is also obstructed by machinery and large steel pipes extending about one eighth of a mile down the beach. Apparently there is an "act of government" clause in the agreement which covers the property management somewhat. My question is, if this has been an ongoing project, shouldn't this information been disclosed sooner? Is there any legal recourse since we are not getting what was advertised?

    I'm very frustrated. Please help.

    did you verify this with the authorities in charge of the project or the workers on site?

    I disagree with JK.

    It was up to you to do due diligence before taking the place.

    Renting or buying anything sight unseen is always a bad idea.

    Depends on exactly what was advertised.

    But, still, you failed to verify what was advertised.

    so, if I rent a lake cottage I am supposed to ask the rental agent:


    are they doing any dredging in front of my cottage that week?

    and if I don't and there is, it's my fault and my problem?





    Why would a person renting a house have to ask if something that is not typical or ordinary, at least as far as they would know but of course the rental agent would know, might be taking place when they want to rent the house?

    Now, if there is something that is well known, well enough that a person across the country would likely have heard about it and the renter fails to ask, then I can see your point. This is a situation that only happens occasionally at most and maybe only this once so far in history. It is not something that happens every year so why would a person know to ask; are they refilling the sandbox this year?

    and that's the good thing about advertisements; you do not have to verify the truthfulness of the advertisement. It is illegal to use false advertising and it is fraud when used to induce a person to sign a contract.
