    Default How to Know if You'll Qualify for Unemployment

    My question involves unemployment benefits for the state of: CALIFORNIA

    I know its a hard process to reach a human for unemployment, its harder to reach it when you have a pre-unemployment question. I actually reached a human and gave my ssn#, since i wasnt on the record, she just hung up on me without giving me a chance to explain..

    here is my dilemma..in the second half of 2012 I went on disability due to my position at work was causing a lot of pain and literally putting me out of work (but not workers comp, just disability). I got the care I needed and was able to return to work beginning of 2013. Before I returned, I contacted HR and asked to see if any other positions were available for me instead of returning back to my old position. They said nothing was available and I was okay with that, I was just requesting. Then I said ok, Ill just return to my original position but with a few doctor restrictions. To list a few restrictions it was basic things like less hours, limit the amount of lifting boxes and/or bending down, etc. Just things like that so my condition doesn't flare up again. I am perfectly okay to work now, but just as a precaution to myself and to the company, the doctor thinks its best for these restrictions to be applied to my job at least for the time being until I can fully engage the work. So now my HR is not allowing me to return to work and says with these restrictions, we cannot let you back to work.

    My question is, If I am let go because of this I am eligible for unemployment?

    That is far too situation specific for us to guess. The best estimate anyone can give you is, probably.

    If you are let go for any reason, file for unemployment immediately. There is no penalty for being wrong and it doesn't cost anything. The worst that can happen is that they say no, in which case you are no worse off than if you didn't file in the first place.

    i dont want to risk being let go and not getting unemployment benefits, i will need some type of income until I find another job. If i know I will be denied, I can possibly tell my doctor that im "okay" to go back to work with no restrictions and tell HR im okay to go and just take my work easy on my own terms (obviously this option is something i dont want to do, but i cant just stop working and have zero income). Any other suggestions? thanks

    No one but the UI office can say for certain if you will qualify, and they won't until after you've already filed your claim and investigated the circumstances. They will NEVER tell someone yes, you will definitely qualify if X happens or no, you will definitely not qualify if Y happens. And if they can't/won't give you a definite answer, we certainly can't. Any best-guess opinion would not be binding on the UI office, anyway.

    I'm sorry, I know it's frustrating, but there's just no possible way to give you a definite answer. My best-guess opinion, which as I said is not binding on the EDD, is that IF you are let go and IF you are medically able to work, you will qualify. If you are not medically able to work you will not.

    ok i recently got terminated from my employment and filed for UI. I got a bofa card in the mail few days ago and got an edd mail today telling me they want to do a phone interview in about 2 weeks. anyone experience a phone interview? anything i should prepare for? do they drill you with questions or are they more laid back? thanks for the help..

    You were not specific as to the type of disability you were receiving. You should investigate CA disability. You would likely qualify.
