    Default Should Custodial Parent Have to Pay for Visits from One State to Another

    My question involves a child custody case from the State of: New York.

    Even though I have moved from NY before any custody issues have taken place they are thinking about making me pay for my child and I to go visit the non custodial parent. These visit are twice a month at an ACS agency and for an hour. If I won custody of my child should I have to pay to travel so there can be visits twice a month? This is almost impossible as I do not make that much money and I have been trying to get custody from the state for 15 months. I have been traveling to NY once a month for 15 months to go to court and the other parent lives there, neither one of us had custody "child" has been in state custody.

    Yes, a judge CAN order you to do that.

    You won't have a choice if the judge makes that kind of order. You can certainly try to make your point to the judge that it would be too much of an economic hardship to do it twice a month, but that is pretty much your only option.
