    Default Emancipation and Other Options

    My question involves juvenile law in the State of: Ohio

    First off, I want to state my situation. I'm fifteen, turning sixteen in two months, and I live with my mom and my nephew. My sister is neglectful so we have her son, but she never technically signed custody, and my sister is listed as living with us (even though she is 21 and living with her boyfriend who has a long police record). My dad is divorced from my mom and sends regular child support money, but I never see any of it. My mom is very secretive, and is negligent of both me and my nephew (who is a toddler). She spends all of her money gambling, and I pay for my own clothes and school supplies and food. Our house is a mess, there is trash everywhere and dirty clothes and old food, and I try cleaning but my mom says "it may be important, don't do that." I try to go other places, like my aunt's or grandma's, but my mom regularly grounds me and sometimes slaps me, even though I have no record, I am an honor student, and I follow all of my chores and rules. I would deal with all of these problems, but I fear for my nephew. I want to call child services, or talk to a counselor, and try to get myself emancipated so I don't have to live there anymore and I can get my life started. I hope to finish school, go to college, and get custody of my nephew.

    What are the legal terms of emancipation in Ohio, and what are other options I have to get myself safely out of there along with my nephew, without getting him sent away to foster homes or state custody?

    If you feel that you're being abused or neglected, call child services.

    You will not qualify for emancipation. Why doesn't Dad file for custody?

    the last I saw, Ohio has no laws allowing emancipation for reasons other than marriage or joining the military.

    You cannot do anything regarding your nephew.

    Ohio will emancipate a minor under two, and only two, conditions:

    1.) The minor is legally married
    2.) The minor is a member of the active armed forces

    For BOTH the minor needs parental permission, and at your age (and in some parts of Ohio even after you turn 16) permission of the court as well.

    Before you ask, it doesn't matter if your parents are beating you, starving you, and locked you out of the house in a blinding snowstorm in only your underwear - there are NO exceptions to the above. There may be other answers but it WILL NOT mean emancipation. Don't even bother with all the but-what-ifs.

    And no, as long as you are a minor there is no friggin' way you're getting custody of your nephew. And not after you're 18, either under the circumstances you've described.

    Mom is not required to give you any money from the child support. Really, your lame protestations about reasons not to clean are ridiculous. Put the papers in a pile and clean the rest. Do laundry and throw away old food. EZ PZ.
