    Default When Does a Landlord Have to Fence a Yard

    My question involves landlord-tenant law in the State of: New Jersey


    I'm a landlord and I own property in Ramsey, NJ

    The properties backyard is adjacent to active train tracks for the NJ Transit.

    The property has no fencing.

    Am I required to fence the yard off so the tenants (or their families) don't walk into the tracks.
    If I choose not to fence the hard, am I liable for any accidents caused by them walking into the train tracks?

    Absent a law requiring you do so, it would make your property easier to rent to families with children. Have both the neighbors installed fences down the sides of the yard?

    You can investigate local ordinances to see if a fence is required, but the place I would start is your insurance agent.

    Have you investigated NJ Transit's policy on fencing tracks in residential areas? If your goal is to avoid the cost, I would want to investigate whether they'll either fence or contribute to the cost of fencing.

    If I were in your shoes I would fence it...if for no other reason than the fact that very few people would be interested in renting a home at all that abuts active train tracks, even with a fence. Without one, you might have a very hard time renting the place at all.
