My question involves an eviction in the state of: New York
My roommate and I had found a half house for 895 a month that didn't include gas and electric, In December of 2012, using Craigslist. Once we moved in, everything was going well until we noticed how much the toilet had leaked every time it was flushed and the kitchen sink had a small leak under it as well. Once we addressed these problems to the landlord, they were fixed immediately. My roommate then noticed that the crack in his ceiling had a strong possibility of water damage of heavy rains. I then had noticed that later on, up in or attic, that there had been bird droppings that appeared on the walls and floors of the attic and it'd had been from small holes that were around. Over time, there was little rain and no leaking what so ever. Once spring hit, I noticed the problems in the house that went away, came back, but were much worse. More and more birds were still getting into our attic, and seeing that our place was a duplex, our neighbor had noticed that there were 3 dead birds on his attic floor. Seeing that the warm weather was approaching, we had a lot of heavy rains and all of the bedrooms in the house were getting water damaged and causing the rooms ceilings to leak. With that, I let my landlord know about the problems and he said that the conditions weren't too much of a problem for him to tend to, although the roof, he seems somewhat concerned about and. When the first of April appeared, he asked for rent and I then told him we had the rent and I asked him when he was going to fix the roof and the leaky ceilings in the house and he basically said that he wanted his rent first then he'd send his workers in to take a look at the attic and roof and such to see what he was dealing with. by the middle of April, he dropped off a 3 day notice in my neighbor and our mailboxes. The notice looked like it had been typed on his computer and the biggest thing I noticed was the notice was dated April 15th, meaning we had to be out the 18th of April, and he didn't drop it off until April 22nd. Later that day, my neighbor had went down to the police station and asked if there was an eviction on file for his current address and he was told "No." I then began to look for places immediately and luckily, I found a place. My roommates and I began to pack and one of my roommates went forth and sent him a text. saying that he needed more time because he was going to be in Nashville for the first weekend of may and that he was told that the 3 day notice wasn't on file and that he wanted to know what was going on. My landlord then tried calling him after reading his message and was unable to talk to my roommate because he had been on a lunch break at his job. A few days later, my neighbor had moved out of his half of the house. A couple days later, his "Property Manager" came to make sure the place was the way it was before my neighbor had moved in. The property manager then came to our door and had told us if we wanted to stay that she and the landlord would be willing to make payment arrangements and she also had wanted to take a walk through the house to see what we wanted fixed. We weren't interested because we had already had another apartment lined up. Now, were almost done getting everything packed up and ready to go and he expects us to be out on Monday, May 6th. I just would like to know what he's doing wrong and what were doing wrong and what's legal and what's not..
