    Default How to Determine if You're Getting Federal Credit for Time in State Prison

    My question involves criminal law for the state of: Texas

    My fiance was on state probation when he caught two new charges (1 state and 1 federal). He was convicted of the federal charge and was at a BOP transfer facility then got pulled to state court for his motion to revoke - the state dismissed the new charge and sentenced him on his previous state charge that he was on probation for. He is now in a state prison and up for parole. His state court documents state that his state sentence is to run concurrent with his federal sentence. He is up for state parole now and if he makes it will be transferred back to BOP custody. How do we find out if his state time is counting towards his federal sentence?

    In general, the purpose of seeking the commitment to federal prison first, and the concurrent state court sentence second, is to ensure that time gets credited to both sentences.

    Did you check the inmate locator to see if it lists a projected release date?

    The BOP inmate locator says projected release date UNKNOWN. And also shows that he is not in BOP custody (currently in state facility).

    So many felonies...So little time. He can still be charged with the additional state charge until it reaches the statute of limitations.
