I take a photo of you. It's on the street in NYC. You are recognizable. I do not get a release but you're in public with no expectation of privacy. I can use that image as long as I don't make money from it, but, if and when I sell that image--- I need your consent.

These guys were in "private" homes. I would think there would be an expectation of privacy?
