"If I give him my notice to vacate or ask to stay on for the amount of months that I have "pre-paid" , my question is because he received a writ of posession in the past can he just call the sherrif to have me evicted?"
No. Typically when a Writ of Possession is granted, the law enforcement agency associated with overseeing the actual eviction soon contacts the landlord to schedule the date of the eviction. If there is no need for this (the tenant has already vacated the rental unit is the most common reason for not needing to schedule this) the actual eviction process never goes through and the matter is considered closed.
There would no longer be a case held "open" for three years regarding this matter, especially in light of the fact that you have been making payments to catch up on what was owed.
