OP specifically said that he is not recording anything at all, just using the web camera to check in on mom. Plus this is an assisted living facility so mom has her own apartment and has given permission for this. I don't see how it can violate HIPAA.

To me, this would be like an apartment complex saying someone couldn't do that. However, I honestly don't know if an assisted living facility can make rules for their residents apartments that regular apartment complexes couldn't make.
