She's not responsible. She kept her apartment temp to the min required setting. And she has no control of things occurring inside the wall.
If anything, the engineers, contractor, building maintenance would be liable as:
1. this is not the first time.
2. they knew about the potential for bursting pipes - but did not do anything substantive to fix it the first time around
3. inherent design flaws....probably not to code? Which I highly doubt as licensed engineers build to code.
Just a ploy to get others to pay for damages caused by (probably) negligence, or lack of due diligence on the part of building management. I highly, highly doubt they will take tenants to court as the judge would sweep this out of the door on a number of building-related issues. So tell your daughter to tell them to go away...aka "get lost."![]()
