My question involves a child custody case from the State of: Kansas.
My partner's ex-husband has custody of their three children. She's allowed visitation for Christmas break, spring break, over the summer, and they come to Iowa for their visit. In their divorce decree, it states that they're supposed to work out between them when to exchange the kids, and how long she can have them for. Her ex has apparently made plans this summer without consulting her and when would be a good time for her to pick up the kids. He assumed it would be Memorial Day weekend, but she can't get childcare until the 2nd week of June. He has threatened her in a text message that either she picks up the kids when he wants her to, or she won't get them at all this summer. I'm assuming this is in violation of the divorce decree, but she's afraid of saying something to him that will make things even more ugly, and besides, what would she even say to him to get him to back down? I would also assume her other option is to go back to court if he's in violation of the agreement, but that would cost money that she doesn't have. Can anyone recommend good, solid options for us?
Thanks!
