My question involves an injury that occurred in the state of: North Carolina
Not sure if I have posted this in the right place so I apologize if not. Here we go.
The homeowners association is wanting to install an electric gate on a private road at the beginning of our development. The gate is not the issue however the location is. The gate will be located just beyond a blind curve. There will be no turn around at the gate. Anyone who does not have the ability to open the gate will need to back down the single lane road around the blind curve and one other to a point approximately ¼ mile back which has a small turn around area. The road is mountainous with drop offs. The road from the gate to this point is also privately owned but not by our association. My questions are:
1. If someone is injured while backing down this road will our association be responsible should litigation occur?
2. If litigation does occur and our association is found at fault could individual property owners be held liable in an incorporated homeowners association?
