    Default How to Make My Relative Repay a Loan

    My question involves court procedures for the state of: New York and/or Connecticut

    I lent $150,000 to a relative of mine. We both agreed that the sum will be paid over a span of a year in 4 month increments. He paid the first $50,000 but he refuses to pay the rest. I used a bank transfer and I have paperwork for the money I lent him and the money he paid back. I live in New York and he in Connecticut.

    What are my options? Would I file in New York or Connecticut? Do I have a case and what are my chances of getting my money back?

    If you can prove a loan (versus a gift - and you seem to be able to prove the loan since you've received at least some repayments), then yes you'd have a viable case.

    However for that amount of money, it's obviously beyond the scope of Small Claims. The bigger question is, honestly, the question of getting your money back. Getting the judgment is often the easy part - collecting it might be another thing entirely.

    I'd speak with an attorney both in NY and CT to discuss your options.
