    Default 60 Day Notice to Quit

    My question involves an eviction in the state of: California

    Hello - We are renters and have been renting a 3 bedroom 2 bath apartment for the last 17 years here in Bakersfield California. On Friday We received a letter in the mail to quit within 60 days or get evicted along with getting the letter handed to us in person by someone that came by. The main issue here is that we have a lady who moved in about 2 yrs ago who hates us. She then had her adult children move into an apartment directly adjacent to her who started blocking our car. My sister placed a note on her car when she had to leave for work in the morning asking her to move the car. This was over a year ago. My sister has also placed a note on her car on more than one occasion asking her to do the same. This is a simple note stating that her blocking the car is an inconvenience to her and for her(neighbor) to be courteous and mindful of how they park. The older African American neighbor who hates us has repeatedly gone to rental management and complained that we are harassing them and verbally asked several times( every time she has gone to pay the rent) if the rental company has sent us an eviction letter. Rental Manager got so tired of this lady asking her if she had sent us an eviction notice that in order for her to stop asking she sent us a warning for harassment. For what? we don't speak to the neighbors, we don't argue nor do we even know who they are or what they do. All we know is that they reside in the same block unit as we do. Thats it. The neighbor had one of the other neighbors complain stating that we called the cops when they had a domestic dispute because we must have heard them.. we did no such thing nor do we know of or ever heard them arguing. Older African American Lady whose adult children moved in has a male with a white truck that conveniently comes over during the weekends starting Friday and blocks garbage removal. We never said anything. He has blocked my sisters car on several occasion than come out verbally abusing my sister. He only comes over once in a while as he has his girlfriend living there. The girl filed a FAKE police report against my sister who was shocked and taken aback because she had no idea of what was going on the premise that my sister had hit her car and left a small dent in it. On one occasion it just happened that my sister was leaving for work in the morning and so was the neighbor. My sister did not even know the neighbor was outside untill she rudely in a loud voice told my sister she is stalking her. How is this stalking? Now this is harassment. Neighbor always looks at us with an intense hatred in her eyes.. to the point we feel it highly threatening to us that at times we question and think twice before going out when we see company at her house. Now we have been served with 60 day notice to quit because the neighbor who hates us so much(we haven't even associated nor spoken to her once) wants us gone. She was an old acquaintance of my sister who forced my sister into looking for a place for her when she was down on her luck. We regret helping her. My parents are Senior Citizens in their late 70s. We have nowhere to go and don't have the money to move. What legal options can we take?

    You don't have any options.

    If you are on month to month and you were given 60 days notice, that's all it takes.

    Sorry.

    You might consider not paying your rent and use that money to move.

    You'll have to move a lot sooner than 60 days if you do that.

    But at least you'll have some cash.

    Please understand that you are NOT being evicted. At least, not yet.

    I'm going to assume that at this point in time you do not have a written lease. In other words, you are on a month to month tenancy. Such as tenancy only requires a 60 day written notice on either the part of the landlord or the tenant to terminate such a tenancy.

    You have been provided such a notice. As previous written, this is all it takes. No reason for terminating such a tenancy need be provided.

    You need to begin looking for another place to rent. At least you have a rather generous time period to do this.
