    Default How Much Time Do You Get for Violating Your Probation

    My question involves criminal law for the state of: Georgia

    My boyfriend is locked up currently. The charge is violation of probation. A few months ago (before we met) he was arrested for driving with suspended license and was fined and put on probation b/c he could not pay the fine in full. He neglected to keep his probation appointment and payments and now this has caught up with him.

    Why wasn't he charged with driving with suspended license and violation of probation?

    Is it is mandatory that he will get jail time this time around?

    You never said he was arrested again for driving on a suspended. If he was caught doing it as the index offense, that's the reason for probation. If he didn't commit a new offense, then he has a technical violation based on his failure to follow the rules of probation. It's not mandatory that he has to do jail time. However, no one can tell you which way this will go.

    This is the order of events:
    2012 - arrested for driving with suspended license
    ...........he was fined and put on probation
    ...........he did not keep his probation appointments/payments current
    2013 - arrested again (only charge is violation of probation, no other charges listed)

    Failure to report and failure to pay reporting fees...He has a chance to do 364 days minus anytime that he has already spent in jail for this offense. For a DSL, I don't really see that happening. But it is GA, so I don't know how much patience they have.
