I am not sure that I agree with the bolded if the custodial parent has left the child with the other parent.
That is why I asked where the child was currently residing. If the child is currently in the NCP's home and the CP won't take the child back, I wouldn't think that would be considered neglect or abuse as he/she is with the other parent. If the NCP has the child and the CP refuses to take the child back, then the NCP needs to file for custody/child support from the CP and/or state's assistance to help cover the costs of caring for the child.
