    Default Custodial Parent Does Not Want Daughter to Live with Her Anymore

    My question involves a child custody case from the State of: California

    What happens if a custodial parent does not want their child back in the home because they cannot handle them being rebelious and the non-custodial parent cannot support the child either on a full time basis. Is their a way to enforce the custodial parent to take responsibility of the child?

    How old is the child? Where is the child currently residing?

    Yes, there is. The custodial parent bears legal responsiblity for the child. Refusing to take the child back in can result in the CP being arrested. It's a form of neglect/child abuse. If the CP won't, and the NCP can't, deal with the child, then it's time to talk to local social services agencies about options, programs, boot camps, or other alternatives of where to place the child or get help in obtaining the skills needed to address issues of rebellion. But the CP faces serious legal issues for themselves if they simply put the child out.

    I am not sure that I agree with the bolded if the custodial parent has left the child with the other parent.

    That is why I asked where the child was currently residing. If the child is currently in the NCP's home and the CP won't take the child back, I wouldn't think that would be considered neglect or abuse as he/she is with the other parent. If the NCP has the child and the CP refuses to take the child back, then the NCP needs to file for custody/child support from the CP and/or state's assistance to help cover the costs of caring for the child.
