    Cool Moving Out a Month Early

    My question involves landlord-tenant law in the State of: New York

    My roommate and I have lived here in Brooklyn for 2 going on 3 years. We both are on the lease. After our first year, our landlord never made us resign the lease but said we could stay. Is that considered month to month renting? Correct me if I'm wrong.

    Originally, I wanted to keep our apt and have her move out. But I'm thinking there's no legal actions I can take to make her leave. ( even though I found an maintain this apt). So I ultimately I'd like to move out before aug 1st and since this is april how long of a notice do I have to give out landlord or am I bounded til oct? Do I have responsibilities legally to my currently roommate?

    And if there is anything I'm missing as a tenant I'm happy to hear your advice. Thanks.

    Make certain your original lease did not contain an automatic renewal clause. If not, the attached describes what you must provide in regards to terminating a month to month lease:

    It's more complicated because you have a roommate. Best to discuss your goal of moving out early with her.

    Hi Gail,

    I didn't find a clause in the lease from 2010 about an automatic renewal. Thank you for the tenant information, I'll definitely read it over with a fine toothed comb.

    As for my roommate, if I've given my landlord ample time of my terms / moving out. Will he have to work it out with her to find a roommate / new tenant to take over renting, if he choses to let her keep renting? I'd like to know confidently that if i end my m2m renting situation, that i won't have any legal ties to paying rent afterwards / finding the new tenant?
