    Default Can I get my money back from my attorney?

    I'm caught walking out the door by an LP at COSTCO in California in Dec.2005
    (Shoplifting charges $ 250 in 2 bottle of alcohol)
    My Costco membership is revoked for two years and the police are called.
    I'm lead out by an officer in handcuffs and was put through the motions (arrest, jail, release).
    I spend 3 days in jail (charges PC 484/666, 1203.2)
    I checked with my attorney, which I had hired for $3000 and
    he told me: that he will represent me on the day I have to be appearing in court.
    He also told me that I must wait a little time to obtaining of letter from COSTCO & Court, and until that time he cannot do anything for me.
    I have called the court house many times and there are no charges filed.
    …It’s October 2006 ( 10 months) and I still haven't received anything from COSTCO or Court.
    I know that in CA. after being arrested they have ONE YEAR to charge me with the crime.
    My question is: If I never receive these charges, can I get my money ($3000)back from my attorney ?

    Ain't it like any other defective product? If it don't work you can take it back for a full refund?

    I have to ask one thing though.....you boosted $250 worth of merch but had $3000 available to hire an attorney???

    I'm not saying that's flippin' goofy.....but I'm thinkin' it!

    i needed to get an attorney whether or not i did that mistake...there was no way out of it.

    Did you get a copy of any contract or retainer agreement that you can check on this? I'm thinking most likely the answer is no, you can't get your money back (if it was a retainer) but you never know for sure.

    PC 484/666 is petty theft with a prior, which makes it a felony. So I honestly don't know if the 1 yr time frame still applies to a felony. If it's 1 yr and you skate....I'd at least ask Larry Lawyer for a refund of some kind, not that he'll give it up. I forget how it goes, something about blood from a rock.....???
