    Default Contact Rules With an Incarcerated Sex Offender

    Ohio:
    my child's father was recently convicted of F1 rape of a minor child. in the months from his arrest until conviction, the judge had issued a restraining orderi prohibiting him from any contact with victim/ family, all minor children including his own. now that he has been sentenced it has come to my attention that this order no longer exists. I cannot find any information regarding the rules for contact regarding a now tier 3 sex offender. I am getting conflicting opinions from the professionals I have contacted as to whether or not he should/ should not be allowed, whether or not he is or isn't legally allowed to contact my child, and how this should or should not be facilitated.

    If you are concerned that if you take your child to the prison they will deny a contact visit, and you want a contact visit involving the child, ask the prison to tell you its policies.

    If you're concerned about something else, tell us what you're concerned about.

    I am concerned because I do NOT want my child subjected to a prison visit. I am concerned that he now has the ability to place a phone call to my number. In the immediate reality, that seems simple to address: just don't answer the phone. I don't think he would actually have the nerve to contact me anyway. however, my very real concern is that my child spends time occasionally with her nana- his mother. my child knows that his mother is allowed to speak to him, and can't understand why she isn't allowed to speak to her own father. initially in the wait between arrest and conviction, the judge placed a restraining order including a no contact order to cover his own child. however it has come to my attention- after speaking with the victim advocate on the case and the actual processing prison where he's being held- there is no such stipulation any longer on his sentence. the jail itself told me the call could come at any time.

    does anyone have any recommendations regarding whether or not I should facilitate any contact at all or should I go ahead with obtaining a no contact order myself?

    You can use this arrest and conviction as a point of concern and petition to have an order constructed to prohibit contact with you and your child.
