My question involves a child custody case from the State of: FL
In a nutshell, I have two children with my ex wife. We are divorced and have a parenting plan we are ordered to follow. In the two years since the order was finalized, here is what she has done:
1. Not had the kids call me 3 times per week.....as per the order. She usually has them call me once every two weeks.
2.Relocated twice (within 50 miles) without notifying me or the courts first.....as per the order.
3. She doesnt communicate through ourfamilywizard.com regularly. ... (Thats our method of communication)
4. All of the kids lives, they were in public school. She enrolled them in a very small Christian school last year. Problem is, the parenting plan says she is suppose to make all major education decisions with me. ( She didnt even let me know until after they were enrolled)
5. We have mutual restraining orders against one another.....except when we attend the kids school functions together ( as per the order). I showed up for the kids open house, she called the cops on me during open house and tried to have me proscecuted.... Didnt happen though due to me having my parenting plan paperwork with me.
6. Parenting plan states that I shall email her the schedule of all pickups, dropoffs times, dates, for the entire school year in advance to avoid any conflicts or disagreements. I did this. She followed this schedule perfectly for 3 months until one weekend I drive 1 and a half hours to pick up the kids from school and she took them out of school early and said that it was not my weekend. (It was)
I am not hiring an attorney for this. ( Cant afford) Already spent lots of money 2 years ago. I have since picked up MOTION FOR CIVIL CONTEMPT PAPERWORK . I am filling it out now. ( Not fun)
Do I need to include ALL evidence of her violations in the original motion such as phone records, emails, police reports or keep it brief and to the point in the motion and just bring evidence with me to court to show judge? That is my main question. I will probably have more questions if someone takes the time to read this and respond.
