    Default Police Surveillance of Suspected Drunk Drivers

    My question involves criminal law for the state of: georgia Can the police start recording me on cop car camera before alleged failure to maintain lane happens? Basictly the police video shows me being followed and recorded before my wheel crossed the solid white line but in the police report it clearly states that he saw me cross the solid white line "and then" he turned the the car video recording device on NOTE: 1)the car crossed the line of a one lane into an up and coming second lane (travelling in the same directions) 10 feet before the second lane revealed it self whiich was a road way exit!!! 2) Also the car broke the solid line once but the police video shows me being recorded and followed long before that happens but the police's report states that when my wheel crossed the line that one time,, he then turned on his car video THANK YOU FOR ANY REPLYS

    CAN they? Sure. WILL they? Not too likely.

    Apparently he was not aware of the continuous nature of the recording, or that it saves the first 30 seconds or so before manual activation. Unless the video exonerates you, what's the difference?

    Anyone can tape anything at any time when you're out in public, including police. If their IT department wouldn't pitch a fit, every cop everywhere could tape every vehicle on the roadway, all the time. There's nothing to prevent it, other than the financial/equipment, and time/data mining issues that would be inherent in long term recording - all of which are only internal logistical problems for the agency. But with unlimited recording resources, they could record from the minute the turned the key in the patrol car until the minute they turned it off at the end of their shifts.

    And it's likely that what happened is that the officer saw you cross the line the first time...then activated the camera...after which you AGAIN crossed the line - the second crossing being the one that got recorded.

    Many newer digital devices will buffer a few seconds when they are "on" before the camera's formal recording activation, and when the camera is activated it will save that buffered image. If not activated, then the buffered frame (maybe 30 seconds or less) will constantly be over-written. It really depends on the device.

    The police officer actually said on camera while giving me a field sobriety test "Dont worry this is good practice for me giving you these tests"

    He then arrest me for breathalyser refusal but waits twenty min for my girl to get there to drive the car away , She walks up to the car and tells the officer " i took a sleeping pill and im tired should i still l drive" and he lets her take the car and drive home even though shes visibly half out of it in her movements

    in case your wondering how she got to the location she walked being the house was 1/4 mile away

    And none of that will do anything to change the facts of the case against you.
