    Default How Long Does it Take to Settle an Accident Case

    My question involves an injury that occurred in the state of: washington

    i finally hired a lawyer for my injury case becasue it was going nowhere with the insurance after they had me see the "independent specialist" and stopped my PIP benefits.

    after 2 physical therapy sessions it didnt get better, i call to ask for PIP to be resumed and they say i have to go through arbitration process and it will take 6 months.

    i hired a lawyer and he keeps saying its a solid case. sent me off to one of his doctors that recommended an epidural shot and chiropractor... i know epidural shot is an expensive procedure and doctors love that...
    and will insist very strongly on you doing it like they did with my wife when she gave birth( which resulted in more sideffects and a c section) so im not very happy about the shots. i did some research and it seems like there are alot of sideffects from epidural injections.

    i never had to hire a lawyer before and today i asked him if he can keep in touch with me and call me once a week to update on how things are going in my case.
    he got a bit defensive and said that its a slow process and will probably take long time and 1-3 weeks for each step.. so im thinking about 6 months.

    and he kept changing the topic back to me going to the doctor and let him worry about other stuff.

    i have a feeling that they are trying to max out my pip coverage. and once its done the case is gonna be magically settled and i also have a feeling that he will hit me with bunch of "office fees" or

    the contract is 30% or 40% if case goes to court and then on top is the hourly rate for office work and other stuff.

    i tried to read about picking a lawyer but i really not that great with law in general and feel like a guy that walked into a mechanic shop to change oil and gonna end up rebuilding an engine.

    im already stuck with 1300 dollar bill from MRI after everyoen said just do it and worry about bills later, well bills get sent to collection and at the end of the day im the one stuck with them.

    and i really dont want to make the lawyer few 1000 dollars richer and not gain anything out of it besides some generic chiropractor and inflated bills for their service.

    There's a world of difference between an epidural administered for pain relief for an injury, and an epidural administered during the birthing process - you can't really fairly compare the two.

    Outside of that, what's your question?

    anywhere from near instantly to never. Many cases are not settled until after the statute of limitations has expired as many lawyers will wait until the last minute to file suit (which stops the running of the clock) due to wanting to wait as long as possible to try to determine the extent of the injuries and their prognosis. After the filing of a suit, it could be years before it is settled.

    PLUS an hourly rate for office work? That is unusual. There is usually liability of the plaintiff to pay certain costs above the contingency rate but those are typically costs other than anything directly related to the lawyers office and their actions.

    It depends on the severity of the injuries, your lawyer, if the case will go to court, and how quickly the insurance company wants to settle. Five years or more is not unusual for a contested court case. If you are willing to accept an out of court settlement it sometimes will be settled in weeks.

    If you have a lawyer ask him when he expects a settlement offer or court date. If he received an offer he should have already told you what it was. If you're on your own call the insurance company and ask them what they're willing to settle for now.
