    Default How Does Criminal Discovery Work

    My question involves criminal records for the state of: California
    I am being charger with a drug related felony and want to know if I have the right to see the discovery reports? If so do I have to request in writing? Also I have court tomorrow and want to know if I can ask for a continuance in order to allow me time to review discovery

    Your ATTORNEY can receive discovery and then he or she can show you whatever it is you might be able to see. The DA is not likely to provide YOU with discovery, however, unless the court has signed off on you acting as your own counsel.

    If your court hearing tomorrow is the arraignment and you lack the assets or income to pay for an attorney, you can ask the court for appointed counsel. You will either receive counsel at the hearing, or the matter may be put off until you have had a chance to consult with that counsel. But, if you want to seek a continuance to seek discovery, that is not likely to happen as your attorney will get that when he has been assigned or presented himself to the court.
