Default Possibility of criminal reentry charges

I live in California. My husband has been here since 1987, in 1999 he had a brain tumor(cancer). In 2002 we married and aplyed to bet his papers. In 2004 we went for interview and he was arrested and deported. Made big mistake in having him come back, but I wanted him to finish his treatments for the tumor. He was arrested, and is serving 27 months in prison. He has been ill the whole time he has been there. He is due to be out in 8 months. I want to know will they then charge him will illegal reentry? There are inmates in with him who have been in prison 3-4 times deported and never charged with this. He has only served once 10 months in 1995 for a felony conviction. No trouble for 9 years until this. Thanks

Why has he been held in prison for the past 27 months?
