    Default Landlord is Asking Us to Buy or Move Out

    My question involves an eviction in the state of: Indiana - My daughter and her boyfriend have lived in a house for 2 years and have paid their rent on time every month. There is no lease involved . . . they are renting from a "friend" The friend (landlord) has asked them to either buy the house or move out in 30 days. Due to many and involved circumstances, 30 days is practically impossible. Can my daughter be "legally" kicked out after 30 days. The landlord has spoken of "maybe" selling the house but had never listed it and it is not listed now. Another wrinkle - The landlord has always insisted on cash only to avoid paying rental income. . . . therefore my daughter has no record of payment. My daughter thinks 60 or 90 days notice would be more reasonable. What does the law say? Thanks

    With a "friend" like that she doesn't need enemies.

    Yes.

    Indiana landlord tenant statute IC 32-31-1:

    (a) A tenancy at will may be determined by a one (1) month notice in writing, delivered to the tenant.

    As to the cash payment . . . the rent was (is) very reasonable . . . 300.00 per month, so the credit on state taxes would be a moot point if the rent was 600 or 700 dollars. The landlord owns the house outright and only pays property taxes and homeowners ins.
