    Default Can a 15 Year Old Debt be Enforced

    My question involves collection proceedings in the State of: Virginia.
    My car was repossessed in 1997 1-2 days after I spoke with the creditor and sent a payment that "supposedly" would protect me from repossession. They came and got the car anyway, then billed me $4000+ dollars to pay off the debt. I NEVER agreed to pay them anything after what they did to me. The first few years they called a lot and offered deal, but I haven't heard from them since probably 2006 at least and it doesn't show up on my credit report.

    Jump to March 2013, from NOWHERE I get a call telling me I still owe and how would I like to pay them. I told them they would never see a dime!
    Question: How do I get them to quit calling me 6 times a day? Am I right that the SoL is totally passed? Can they still pursue legal action and how should I handle that?

    Are you still in Virginia?
    Did they get a judgement against you for the deficiency in the repossession?

    You should tell them that you do not wish to talk to them and follow it up with a letter telling them to stop contacting you.

    If you get served with a lawsuit, get a lawyer.

    The debt was probably bought up by a zombie debt collector for pennies on the dollar.

    Yes, the SOL has long ago run out. It was 5 years (8.01-228).

    I think there is something in there about sending them a letter and then being able to sue them if they don't stop.

    Thank you for your reply. I feel much better about it now. I don't like ignoring my responsibilities but I really hate how they treated me from the beginning and how repossessions are are handled in general. Have a blessed day!

    Yes, I am still in Virginia. As far as I can remember there has never been a judgement. I do remember that they tried to make several 'deals' -- such as I could pay them $2000 to make it go away and I never agreed. I figured they were dishonest with me when I sent my last payment in good faith, they got the vehicle, they won already!
