Default Collecting and Modifying Child Support in Texas

My question involves child support in the State of: TX

My wife's ex currently owes over $10,000 in child support and arrearages. Her child support is set up through the AG, but he refuses to work and pay anything. My wife finally got a court date to address the issue. What can she hope to have as an outcome. Will they put him in jail? Is it possible they will forgive his arrearages since he is not working? Will they automatically reduce his payments? He is capable of working but choses to go to school instead. He is getting money from his Post 911 Montgomery GI Bill can the courts force him to use some of that money to pay his child support?

Putting him in jail won't help Mom much, now will it?

They won't forgive the arrearages but Dad can file for a modification. Since he's choosing school over work, a downwards mod is not likely. No, the court cannot intercept his GI Bill money.
