    Default Ex Boyfriend

    My question involves landlord-tenant law in the State of: OHIO

    My daughter's ex-boyfriend moved out of their apartment 2 months ago and left for Tennessee. He is on the lease agreement. She has been paying the rent and bills since he left with NO help from him. He is now indicating that he moving back to Ohio and since his name is on the lease, he is going to move back into the apartment. Does she have any recourse? Can she have him removed from the lease since he left and has offered no monetary support? Or does she have to let him move back in since he is on the lease agreement? She does not want him to move back in and has indicated that she will have to leave if he does; however, based on past experience he will NOT actually pay the rent and then she will have that issue to deal with.

    is this a term lease (1 year, etc.) that has not yet expired?

    Since she has done nothing in the 2 months to have him removed from the lease, he remains a tenant and can move back in. The only recourse she MIGHT have is if there was a history of domestic violence to her on his part (your posting does not indicate this). Has she discussed any of this business of taking him off the lease with the landlord prior to this?

    She can, of course, sue him for his share of the rent she has been paying. If she moves out she will be breaking the lease and, as you have indicated, unless someone continues to pay the rent until the lease normally expires, the landlord may decide to sue for owed rent.

    Whether she can get his name off the lease is strictly up to the landlord.

    And it's unlikely to happen.

    As a former landlord I can tell you that landlords don't give up two sources of recourse in exchange for just one. Plus the landlord would be breaking the lease with regard to the boyfriend and could subject himself to a lawsuit.

    As for keeping the boyfriend out of the apartment, a restraining order would do it, but she would have to have grounds.

    No domestic violence and I am not sure if she has talked to the landlord or not. I know that she talked about taking the ex to court for the rent, but she has not done it.
