My question involves labor and employment law for the state of: California. I applied for a city position working at the irrigation department. I passed the whole hiring process except the background check from a conviction in 2004. I did research and found ca civil 1786.18 (a)(7)(8) that states a consumer investigative agency can't show records more than 7 years old. I brought this civil code to their attention and finely after 2 weeks got a reply that this code does not pertain to this situation one because the job that i applied for is for a government position and second, they do their own internal background checks.
Also the federal law; 15 U.S.C. § 1681c(a)(2) states: (“[N]o consumer reporting agency may make any consumer report containing . . . records of arrest that, from date of entry, antedate the report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period.”)
SO I guess my question is, would the Department of Justice be considered a 'consumer reporting agency'?
