    Default Advice for Retail Fraud 2

    I was caught shoplifting In michigan. The cost was $380 so it was considered retail fraud in the second degree. I live in ohio and last may I got pulled over for drag racing. I went to court and got on a "pre-trail diversion" program, I already completed my defensive driving class, but am on some type of probation til next may (no probation officer they just said dont do anything again). So last monday I went before the judge in Michigan for retail fraud. I plead guilty to retail fraud 2. The judge said he wanted to find out more about me before sentencing me. So he sent to the "pre-sentencing investigation" where I filled out some paperwork. Well I didnt put down that I was on probation. I have a meeting tomarrow with a probation officer. Should I let them know I am on probation for my "drag racing" ticket?? Will that affect my sentencing? What type of sentence should I look for? I am almost 20 years old. No other retail fraud or other criminal convictions besides a speeding ticket and the "drag racing" ticket. On the paperwork for the PSI I let them know that I am currently in school, I recently got engaged. What type of sentencing could I get? I am out of state does that affect anything? What type of questions should I be expecting tomarrow from the probation officer?

    Will they be able to find out? Does it matter if it pertains to the same type of misdemeanor or not? Like would they look at the drag racing as a misdemeanor therefore up my charges, or would they consider it completely irrelevent to retail fraud and not sentence me worse???

    Yes they should be able to find out and what will ahppen depends onhow angry judge is over your non disclosure!

    They're probably not going to detect a pretrial diversion out of Ohio, but if they do the consequences could be serious. If you have a lawyer, discuss this with your lawyer.

    What type of sentence should I be looking for? The meeting got postponed til next tuesday. What type of sentence would I be looking at if I was to tell them about the diversion program I am already in, in ohio? and that I am on a type of probation?? Will this affect my probation for ohio ??? What type of sentence would I be looking at if I dont tell them?? I guess right now I am just wondering if I am going to get jail time or not?? and what type of fines I will be expected to pay?? What type of probation can they put me on? Like they cant put me on one where I cant leave the state, because I dont live in that state, correct??? Just looking at what I could/should be expecting???
