The following is a story of my struggle to maintain my innocence!
On March 23rd, 2004 between the hour of 7:45AM and 8:30AM someone broke into my, at the time, fiancé’s home both burglarizing and vandalizing the residence. The perpetrators also poured a “BLUE CHEMICAL” substance throughout the house. (KEEP THAT IN MIND). My ex called me around 8:30ish and asked if I was there retrieving my things since the alarm was going off. My response was, NO, I’m in (hometown) which is some 70+ miles away. After some time passed she calls back and accuses me of the alleged crime. An officer with no expertise in criminal or psychological profiling put the idea in her and the family’s head that it was “personal” and not random as he investigated the home. She started saying my own burglary was staged and that was my motive for committing this alleged crime. (my home was broken into on Dec 16th, 2003.
A hard drive was stolen, which she claims had vital info on it incriminating me. Also, an alleged confession note I supposedly wrote months before was stolen. Moreover, all of the items were found off of a highway about 15 to 20 miles from her home in the direction of my hometown by some random man we interviewed later on. The PC was un-recoverable and we have her on the stand admitting the handwritings on the note are not the same. (2 differing styles). I also had one knowledgeable individual look at the note and compare my handwriting…he said; “it does not look like mine, but perhaps someone trying to mimic it”. She also claimed I was the only one who knew the alarm code and her neighbor saw, not my truck, but one like it. Keep in mind her ex-boyfriend of seven years stayed the night before the crime took place. Could the neighbor be mistaken?
About five days pass and we barely speak…so on that following Saturday she calls me to come and get the rest of my belongings. Me, an aunt, and my mother drove the 70+ miles to her home…I even drove speeds of 90-95 miles an hour to show my family that it would be impossible to get from point A to B in the time this crime occurred. When we arrived at her home I was immediately taken into custody. Keep in mind her father is a retired policeman for the area this is being tried in. Her ex boyfriend was there too. I was set up! I then went to jail posted bail and got an attorney. I am charged with one count of simple criminal damage to a residence with the damage amounting to more than five thousand dollars and one count of simple burglary of an inhabited dwelling.
Keep in mind the very next night; someone tried breaking into her home again! Who, and why? We still do not know.
She even called me at a friend’s house to verify if I was there and I was. On the question in morning my friend, the person who I was staying with since the breakup saw me around 5:45-6:15AM when he awoke for work and his time card has corroborated this. He got to work for 6:24AM on the day in question. I also had my truck in a mechanics shop that was dropped off the evening before around 5:30-6:00 to be diagnosed. I was to pick it up the following morning. On the morning in question and after my friend left I slowly started my day and by 8:00AM I was at the mechanics shop, spoke with him, and another guy, heard the problem but didn’t have the funds to fix it right away. The rotor was completely worn down and I should not have even been driving the truck. I got a receipt/itemized bill from the mechanic stating the price, work needed to be done and date picked up. In addition to this, and right there after, I went to my grandmother’s home. She corroborates the alibi since she had an AARP meeting that afternoon and remembers clearly that morning that I arrived by 8:30AM…she was on the front lawn watering the garden. I got out and spoke to her…I even pulled into our next door neighbors driveway…our neighbor is a life long friend who is currently dying of cancer, is a devout Catholic, her brother is a priest, and she is literally dying. Why would an 87-year-old woman, who lived a strict Catholic life all her life, lie now…right before her judgment day? This woman, before she fell seriously ill had a set routine…she tells the same story because it’s the truth. She wakes up around 5:30AM, puts on a religious TV show, says prayers, gets ready for the day…says more prayers right before her cereal, looks out her windows since she can’t see too well and states she saw me between 8:30AM and 9:00AM. I even went to her home to see how she was at the time and even changed a light bulb for her. She passed comments about how well trained my dog was being.
The judge, ADA, and my attorney, came down to here her testimony in her own home since she cannot travel. Once that was over the ADA tried to offer me a plea on her front lawn…I kindly told him to stick it up his !@#$!!! I “DID NOT” do what you’re trying to send me to prison for so I will not accept a plea. Also, I have another objective individual at a business who testified that he saw me between 9:30AM and 10:00AM, which corroborates all the other accounts. Why would this individual, whom I do not know, risk his career and life to lie for me? Why would the mechanic run the same risk of losing his shop? Why would an extremely pious Catholic dying woman lie right before she meets her maker to simply lie for me?
I have five individuals who swear they saw me on the day in question from 5:45AM to 10:00AM…It is against the laws of physics to get from my ex’s house to my home town, commit this act, dump the items that would supposedly incriminate me and then simply dispose of them? What would be the point? Why didn’t I keep the incriminating evidence if I had it in my possession?
I even yelled from day one to subpoena my cell phone records to show which tower picked me up. The state did it too late…they only go back so far. The police investigating the crime did not do a thing but come straight after me.
It’s been a year- four months and $55,000 later since this has happened…she has a baby by the old boyfriend of seven years, they are now married…and guess what? My investigator found out he’s a sales rep for that “BLUE CHEMICAL” substance they found in the house. Does this sound fishy?
I am, in the mean time, suing my insurance company for stopping payment on the claim as I defend myself against these accusations. What concerns me is her dad being an ex-cop and she having influential political friends. We tried getting her served for a DNA test but she seems to keep dodging the papers. What is she hiding? I on the other hand have a well-respected lawyer…who says the ADA does not believe my witnesses and this is going to trial. Why did he offer me a plea then? And, how can this continue with such overwhelming facts on my side?
My ex is trying to claim she put me out of the house on March 2nd 2004 and would not leave her alone. We have her lying about the weekend of the 12th, 13, & 14th we spent together, as well as a night or two during the month of March. And not too mention, we never fought or were disrespectful to one another. She’s attempting to portray me in a horrible light…but we can shoot down her accusations with facts. She led me to believe that we were going to work this out, but just needed some time. Well, then I did not see it…but I sure do now!
Again, I was the only one to know the code to the house as she claimed… We have her testimony where she lies about the fact that others knew it as well…she tried to tell us and the judge the once ex-boyfriend and now husband never knew it and still doesn’t…odd? I knew it the first night we met! Also, a coworker who watched my dog when we went to Disney World knew the code…an about two other ex’s know the code.
Just weeks and days before this occurred we were in the process of taking time apart and were on good terms. She left me once a few months before this for him…after a week of not speaking to her she called crying and begging for another chance. I knew then to leave it alone and she would see her ill judgment…sure enough she did…and then this happens.
Additionally, I was to begin a new job in her town, bought her a pure bred Yorkie puppy we had just picked out two weeks before and paid for on the 19th of March… and I was taking an apartment to remain by her to work this out. Keep in mind, I am from a city about an hour & half away from her and don’t know anyone. Why would I stay in a place where I knew no one if she truly and honestly ended it on March 2nd? She actually stopped mid sentence and told the judge “ I hope this doesn’t ruin my credibility, but I just lied”. Lies about the time she claims she put me out and the time we spent thereafter.
The ADA only has the alleged note, and circumstantial evidence, which is a neighbor testifying he didn’t see “my truck” in the driveway, but one like mine. I had a black Ford F250…the husband drives a maroon GMC…at 7:45-8:15 in the AM is it possible for the neighbor to mistake the two trucks? I, on the other hand, have five witnesses who put me 70+ miles away when all this was taking place…what do you think will happen to me? Her dad is an ex policeman…she has successfully dodged subpoenas…and she is connected financially and politically. I’m scared! Any suggestions?
