    Default Third Offense MIP

    so the other night I was riding home from a party with a friend who is 23. I didnt realize he was over the legal limit and not long after leaving the party he mentioned he shouldnt be driving and pulled into a gas station parking lot. we were trying to find a dd or call a cab, and a few minutes after sitting in the car a police officer pulled up behind us and said our vehicle matched the description of a erratic driver. my buddy got a dui and I got a mip-3rd offence. the thing is, I turn 21 less than a month after my court date.

    Is there anyway I can push my court date back a month so im 21 when im at the stand? I really dont want to go to jail, but really dont want to pay for a lawyer unless I have to.

    The catchword here is "MINOR"! Unless you can find a Delorean with an operable flux capacitor, you're pretty much hosed.

    Secondly, if you wanna avoid (possibly?) any form of incarceration, you may wanna save up some nickels for some sorta legal representation. Methinks a judge would rule sorta harshly toward a three-time offender.

    I realize it wouldnt get dropped, just am thinking the judge would go easier on me?

    Maybe on the first one.

    Not all that too likely for the second.

    A third is indicative of a plethora of underlying factors, like maybe the need for counsel, both legal and therapeutic. (i.e. rehab?)

    A judge is going to be HARSH on the third offense for the same thing.

    You an expect that the judge may order you into Alcohol Ed classes, possibly even rehab.

    If you really want to make an impression on the judge, entering a rehab center/program and attending every AA meeting you can find would be a good start - BEFORE your court date arrives. Like get your butt to AA today!
