My question involves landlord-tenant law in the State of: California
my apartment owner is very mean spirited and vindictive. she is the type of owner where it's always the tenant's fault for everything wrong in the unit (like cracked tile from a burst water pipe, rusted garbage disposal, old grout etc.) today she and the apartment manager came in to inspect recent repairs. she became disrespectful (harassing) me in the unit then took her cell phone and literally began recording me, clearly without my permission after i told her to get out of my unit. the on-site manager just looked stunned. i didn't receive a 24 hour notice and let them in because i just so happened to be home. i believe she did it to provoke me into losing my temper on camera (which did not occur), but she could be heard goading me on tape so it only looks bad for her.
i feel violated. she threatens me and is always rude to me, but this time was atrocious. i looked up the CA penal code that governs recording someone in a place where they have reasonable expectation of privacy, regardless of my state of undress. her being a landlord is not defense to video taping me without my permission in my unit. the law is CA penal code section 647 (J) paragraph 3 (A) and (B i & ii).
she also refused to leave my unit (even without the 24 hour notice to enter) because she *owns* the place (her words). she then continued to follow me into the courtyard, screaming and slandering me where everyone could hear.
what is my legal recourse? i don't deserve to be harassed by her. i pay my rent on time and i have no issues with my neighbours or the on-site managers. i also don't want to move and she already makes my life hell, i can only imagine what she'll do if i complain to the city or hire an attorney. but i do feel legitimately violated.
did she overstep her rights as an owner and encroach upon mine as a tenant?
thanks in advance, everyone.
