Recently, the title insurance company resolved a claim of a title risk on the property. The Title insurer canceled the policy and paid the full face value of the title policy. Since that doesn't necessary imply that there is an actual defect in the title, nor that there isn't a defect in the title, yet in such, is seller legally responsible to disclose that type of information when the property is being sold "as-is" and "without warranty."?
