My question involves collection proceedings in the State of: Washington
I want to file a lawsuit against GC Services because I had a payment plan set up with them for my student loans. I had paid faithfully for seven months out of nine. In February, something happened and the transaction did not go through. They called me, left a message, I called them back, and I gave them new account information so the payments would be automated for the last two payments.
Because of an "internal error" the eighth payment did not go through, nor was the account information processed, and they say there were phone calls from a different number, but no voice messages, no effort to contact my place of employment, or the alternative numbers to get the issue resolved.
Today they called my place of employment to let me know the situation and that I defaulted on my loan and I have to start the nine month process over again. They also let me know that had I called two days ago I could have made the payment and my payment arrangement would still be intact.
Do I have a valid case to file? I feel as though I am being extorted and I also believe that I am not the only person in this situation.
