My question involves landlord-tenant law in the State of: Tennessee
My mother and brother moved into a rental and signed a 2 year lease in February 2008. Both names were on the lease. They signed another 2 year lease in February 2010. After that, the landlord put them on a month to month, and no new lease was signed. My brother abandoned the apartment in January of this year, and my mother has no way to contact him. She tried to put in a 30 day notice, but the manager said that both names have to be on the notice because both names are on the lease. The lease doesn't technically expire because she is on month to month, and the last lease expired in 2012. What can she do to remove my brothers name from the lease so she can put in her notice and move out?
