    Default Taking Dealer to Court for Letting Me Leave Dealership with No Insurance Verification

    My questions involves a dealership that sold me a brand new financed car and gave it to me with the insumptions that my previous financed car had full coverage .. I took the new car thinking that everything was ok with my insurance. The dealer never got a binder from my insurance stating that it was ok for me to take the car.. I got into a accident 2 days later and my insurance did not want to pay for the damages on my vehicle because the old car only had liability insurance even tho it was financed .. I forgot to take the insurance pictures and they automatically suspended my collision coverages... Is the dealer at fault for this ?? Are they liable for any of this??

    I'm still fighting with the dealer to fix my car .. Should I get a lawyer .. They keep saying that it is not there fault

    It was your responsibility to insure your car. Since you did not provide the name of your state I cannot verify if your state requires insurance but most do. If your state does, all the dealership is doing as far as insurance goes is making sure you have what the state requires for them to give you a plate.

    If you read your loan paper, you will discover you are responsible for making sure the car has full coverage insurance. The dealer is not liable. Your committing fraud on the previous loan company is not their fault either.

    I have to ask, purely for the sake of my morbid curiosity, what train of thought leads you to believe that any responsibility for your situation lies anywhere but squarely on your shoulders? Were they to pull you outta the driver seat or block your exit or flatten the tires to prevent you from driving off?

    Inquiring minds just gotta know!

    The responsibility for your insurance rests solely on you.

    The dealer has nothing to do with it.

    So you only had liability on your old car, and nothing on your new car...
