My question involves criminal law for the state of: California
Hello,
First of all i would like to thank you for reading this. I am currently on juvenile probation for a first time offense of stealing two 18 packs of beer from a local liquor store. I ended up receiving a felony for burglary and was given a year of probation. I have been on probation since March 16, 2012, and on the way to now have violated for smoking marijuana 4 times. The first time I got my 760 program or something like that taken away and had to complete a drug class which I completed, second time I was put on home supervision for 30 days and another drug program which I successfully completed again , third time was sentenced to 21 day STOP program and successfully completed that. And the fourth time I got 45 days of home supervision. After the 4th time I turned 18 and had a court date set for April 26, 2013 to get off probation, but just last week I violated for smoking marijuana again. My probation officer said there are 4 things that could happen in court. I could go to Camp Barret for a year and get terminated when i get out, I could get STOP again, i could get Home Supervision and have to complete an adult inpatient rehab, or i could try to get terminated. Right now I really want to get terminated so that I can start my life on my own and i want to ask for tips of what i could write in a letter to the judge that could help him understand where i am coming from and help convince him to terminate me.
So with that being said here is a little background on me and what i plan to include:
Like i said i am 18. I am a Senior and have 3 months of school left and have gotten A's and B's in high school and am still maintaining those grades and if i were to have to do an inpatient or go back to juvie then i would not complete school. Before i got in trouble i had 130 hours of volunteer time with the American Red Cross and plan to either go back and volunteer more or do an internship with my old supervisor. I am looking for a job because I want to move out of my house due to family issues(adopted-father[my grandfather] always inappropriately yells and cusses, and left bad memories not related to the yelling for me to live with.). I have completed 3 teen drug classes and understand what drugs do to you and why we should not do them. I have completed all the things probation has given me (fines,classes,etc.) except for not using marijuana. I now i can stay clean and i know that it is time to grown up and stop using in order to get a job and not get in trouble with the law in the future. also smoking marijuana is not the same to me anymore i don't rationalize my use how i used to when i was under 18. I feel like the mess up of the family and feel/know that my decision are not the right decision to make and really want to change that. So right now that is all I have everything that i said is true, and like i mentioned before i wanted to know if anybody has any advice of things i could bring up or do to help convince the judge.
