    Exclamation Child Protective Services Demanding a Drug Test

    My question involves child abuse or neglect in the State of: Michigan.

    I have a relative that's been dealing with CPS for over a year now. The child had an accident at school twice, by accident I mean a potty accident, he went in his pants. The school decided to call CPS and they ran with it from there.

    The relative was told to take him to the doctor which she did, she was told to do a few counseling sessions at the office of CPS which she did. He was said to be a smart and bright child, happy, no signs of abuse or neglect and we all thought it was done from there.

    Fast forward to a month or so ago. He goes to school and has another accident. He made a mess, the school calls CPS again. Turns out he had the flu or some sort of stomach bug and continued to have issues at home for the next few days.

    CPS shows up last week, says they want to close out the case but some things needed to be done first. It was all agreed upon. The lady comes back this morning, was told she wasn't wanted in the home as the other people living there weren't comfortable with the continued invasion of privacy, she forced her way in, said too bad I have to go in. She then proceeds to tell my relative that she "has to" take a drug test, she had no choice. She didn't say anything about it, she didn't make a fuss or even ask if she had to, it was just laid out there for her before she could get a word in. It's been constant threats of taking the child away since day 1.

    My question is, Isn't a court order needed to force a drug test or force their way into the home? There were clearly no signs of imminent danger or exigent circumstances as she was there last week and was content with the situation, she's been there several times. This is about a kid that crapped his pants a few times. I wasn't even aware that once a doctor signed off on him as medically sound and a therapist said he was mentally sound that it was reason enough to harass and intimidate the parents. I'm baffled by the entire situation.

    Obviously there's a lot more to this story that you either do not know or have chosen not to share.

    Your sister should consult a lawyer with the full story.

    If she declined the drug test or tested positive, she can discuss that with her lawyer as well.
