    Default Divorcing if You Married in a Foreign Country

    I'm a citizen of the US who married a UK citizen in the UK. We both moved back to America and she is currently a permanent resident but not a citizen. We both lived together in the state of South Carolina. We separated and I have since moved to Ohio. We have been apart for over a year and are both trying to get a divorce now. My question is, how would I get started? Do I go through the state of SC even though we were married in another country? The reason I ask this is, she is taking care of most of it and she has downloaded some forms for family court and has a question about the forms. They ask for the city, county and state of marriage but this is not applicable in our case. She doesn't want to fill the form out incorrectly and have to pay again to fill out a new one. It took us this long to save up enough just to go this route. Neither of us need a lawyer due to the fact we are not disputing anything and have already split our things up between us. We agree on everything. So I don't want her to have to get a lawyer just to ask these simple questions. Can anyone help me?

    I will add that we last lived together in Anderson County, SC. She currently lives in Greenville County, SC and as I mentioned I currently live in Ohio, Ottawa County. The place we were married was a town called Bildeston in the UK. I believe the county was Suffolk. I have our marriage certificate but I'd have to dig it out. Don't know if any of that matters or not.

    If you and/or your spouse fulfill the residency requirements to get a divorce in South Carolina, you can divorce in South Carolina. The U.K. will recognize the divorce, should that be an issue, although you may need to follow registration procedures under U.K. law in order for the divorce order to be formally recognized by certain government agencies - that's something you can address with a U.K. lawyer should the need arise.

    Your wife will put accurate information on the form about the place of marriage. She can correct the standard form if it is misleading. "Plaintiff and Defendant were married to each other on ________________________ (month/day), _____ (year), in Suffolk County, City of Bildeston in the Nation of England."

    So it's okay for her to cross out "State of" and write in "Nation of"?
