    Default Drug Possession and Theft Charges While on Probation

    My question involves criminal law for the state of: Virginia.

    My sister finally took the plunge and kicked her husband out of their home. He's been using Marijuana, and she finally got fed up with it and sent him packing Wednesday. She went to work and when she got home, he'd stolen several hundred dollars worth of electronics. Took $70 from their joint account, and has been slandering her online.

    My questions are as such;

    1: Who does she contact to turn in the drug related items, should she call them, or take the objects to the police station?
    2: She's contacted the probation officer associated with her to-be ex-husband, he did not call my sister back yet, but I'm certain he's been using.
    3: The police told her that the theft of the Xbox 360, games, 3DSXL, TV, and other smaller objects, wasn't in the scope of their power, since they are married, and its considered 'mutual property' or something. Is there really nothing she can do about it? It doesn't seem fair that he can steal whatever he wants from her house while she is at work.
    4: After all the thefts, she changed the locks, can she at this point press charges for breaking/entering, and theft of property?
    5: Will they even do anything to him for testing positive for drug use, while on probation?

    Please, and thank you. If you could reply as soon as possible, that would be great. I'm heading to the local magistrate to file a restraining order against him right now.

    1) she can dispose of them immediately, at this time SHE is in possession of illegal drugs and paraphernalia.
    2) there is no question , what is your question.
    3) she can sue, most likely as part of divorce proceedings
    4) is he on the deed? if not she needs to formally evict him If he is on the deed she cannot just evict him.
    5) That is totally up to probation and the courts, and she will not be privy to their discussions until and unless he discloses it or if he end up in the police blotter when picked up.


    It sounds like she needs a divorce attorney, he has already demonstrated that he is not going to be a grown-up about this.

    Yeah, sorry, I guess 2 wasn't well thought out. But, thank you. He is not on the lease, and has already tried once(While we were at the magistrates office, no less) to break into the house. There were paint marks on the door handle from the color key he has. Thank you for your reply. According to some law, there has to be a 6 month or more seperation, before any divorce proceedings can occur.
