    Default Chances of Getting F1 Visa when Parents and Brother are Permanent Residents

    Hi All,
    Currently, I live in Netherlands since past 2 yrs. I hail from Southern part of India. This fall I will be joining Stanford University to pursue PhD in Electrical Engineering. I have a scholarship from the Electrical engineering department.

    Now my problem is, my parents and my brother hold green card and are presently in US. I will be appearing for F1 (student visa) interview somewhere in month of April. My worry is as my parents are already in US, will my petition for visa be rejected right away? Also I do not plan to stay in US after my PhD. I want to return back to India. Can some one please guide me on how should I present my case to visa counselor? Or what necessary requisite steps I should take to guard against visa counselors axe?

    I will be highly obliged if someone can provide me guidance and tips.

    With your parents in the US and you living in the Netherlands with Indian citizenship, you have a poor chance of a visa. However, the reputation of your university may positively affect your chances. All you can do is present yourself for the interview; state your case truthfully. There is nothing else you can do.

    My parents are planning to go back to India in May. If they travel back earlier, like in April, can that help my case? Please advice me. I had worked very hard for getting an admit from Stanford. Also I am in Netherlands because I got a chance to do Masters that too on scholarship. Thats why i choose to do Masters in Netherlands instead of US.

    Also, I can easily prove finance requirement for F1 visa as I am supported by University. Can you please advice what should I produce to show strong home ties?

    Hmmm... And the U.S would not want a guy who was good enough to get a scholarship to Stanford, why exactly? We'd be stupid not to take him if he's willing to stay. Also his family already has green cards. They are not asylum petitioners who may or may not be granted asylum or illegals...

    Sound like you have finances. Have your family consult an immigration attorney just in case but I don't see why they would not grant you an F-1....

    Thanks for a prompt reply. My parents have not yet consulted any attorney yet.

    In addition to Stanford, I got also at Berkeley and that too with Departmental fellowship. If one Google's a bit, will find that in my field of study this is hard to get. After receiving my I-20, I started researching on process for F1 visa. Soon I discovered that my parents GC can be a major hindrance. It is bothering me so much now. First I work my ass out for getting into these schools and now an interview can screw up my dreams. I find it very unfair !!! Sorry to explode here but I little upset.
