    Default Renewing a Green Card With a Criminal Record

    My green card expires in October 17, 2013.

    In August, 2006, i was charged for shoplifting, it was under $50.00, i went to court and was asked to do an 8 hour diversion program, paid restitution and two years after it was dismissed by state.

    September 2006, i was arrested for providing false information to a police officer. There was no bonds set, i was let out within 30 minutes. Went to court, the prosecutor asked me to donate $250 to a charity. I agreed, and after 7 months the case was dismissed by state.

    Sometime in 2007, i was cited with urinating in public after leaving a club at night. Went to court, i was asked to do 15 or 20 hour of community service and that was later dismissed.

    These where all misdemeanors. I received a criminal speeding ticket once in 2008 i think, with no prove of insurance. But i went to court, paid the fines, showed proof of insurance and did traffic class.

    Now in November of 2009, i was involved in a car accident in my apartment parking lot after drinking. I was charged with just dui. No arrest. I went to court, and the judge added reckless driving, criminal damage to the charges. I was asked to serve a total of 105 days in jail but only did 55 after doing an alcohol treatment class for 66 hours, and an alcohol education class for 16 hours, traffic school. My total fines came down to $10.000 I have completed all the requirements. Now i am just paying the remaining of the fines, and ignition interlock in my car.

    I am 26 years old, i got my green card when i moved to the USA in October 2003. I am wanting to renew it before it expires in October 2013. I am worried that i will be deported. I am a full-time student in the university currently. I don't have any money to hire an immigration lawyer at the moment. I am scared to apply to for a renewal of my green card. All these happened in the State of Arizona. I now live in Texas and am trying to apply from Texas. And if i happen to get an immigration Lawyer, do i go for naturalization or Green Card renewal?

    Any information that i can receive would be greatly appreciated. How much of a mess am i in?

    You absolutely need the assistance and advice of an attorney. Some social service agencies have attorney services based on ability to pay. Since you are in Texas, there should be many available to you. Start with Catholic Charities and Lutheran Relief.

    rambostall: You've had your green card for more than five years, therefore you're eligible to become a US citizen through naturalization, which would solve your problem. However, part of that process involves establishing that you are of "good moral character". Based on what that link says and the legal problems you describe, it looks like you'll be okay. But even so, I echo T53147 in urging you to seek legal advice.

    If you don't want to apply for citizenship and decide to renew your green card as originally planned, I suspect that your criminal history would be a bigger problem there. Don't quote me on that though.
