    Default Ex-Wife Forcing Me to Sell Marital Home, Threatening Contempt Court

    My question involves a marriage in the state of:Pennsylvania

    My ex took me to court and had a court order for me to list the home for sale, so I did. That was about 2 years ago. We now have a 1st buyer putting an offer on the home (which I'm living in), its a lowball offer and would force me to have to bring money to the table to sell the house which I dont have the money since she took 50% of my pay in child support. Can she get me held in contempt if I refuse the offer on the house? It's not reasonable to me and I need to make a profit on the home to cover moving expenses. Money is extremely tight so a profit means everything to me in this sale. The court cant just make me accept any old offer on the house can they? I have a right to decline an offer I find unreasonable right?

    Does the court order mention anything about an acceptance price? If not, she can certainly ASK the court to find you in contempt, and it'll then be up to the court to figure out if the offered price is REASONABLE. Generally you're not entitled to make a profit, ONLY to get a "reasonable" price, based on the home, it's condition, average prices in your area etc. The court isn't going to care much about your moving costs, since you've known for 2 YEARS that eventually you'd be selling and moving. So you'll have to evaluate whether or not the asking price is "fair", because that's what the judge will be looking at. You have to look at the issue from the COURT's point of view.

    No mention of anything in the court order other than I have to list the home for sale in 24 hours from the court order which is what I did. So how can I be in contempt? Doesnt seem like that wording would make me liable to take the 1st offer to pop up on the house or go to jail...
